St. John’s lawyer, Bob Buckingham, and Corner Brook lawyer, Andrew May, the Lead Counsel in the 2012 Class Action against Western Regional Health Authority for a breach of patients’ personal health information confirmed today that notices have been sent to all individuals who had their privacy breached, detailing the next steps to bring this class action to a close.

“We are pleased to inform affected people a Settlement Approval Hearing shall be held in the Supreme Court of Newfoundland Labrador Corner Brook on Monday, September 9, 2024,” said Mr. Buckingham.

“We have reached a negotiated settlement with Western Health and this settlement will be presented to the court for approval,” said Mr. Buckingham.

The settlement provides for a payment of $700.00 to each affected individual. These funds will be mailed to each class member if the settlement is approved by the Court on September 9, 2024.

Mr. Buckingham noted that individuals may object to the proposed Settlement, and they have the right to attend Court to object to the settlement. “If anyone wishes to object to the proposed settlement, they have to file written reasons with my office by August 1, 2024,” said Mr. Buckingham.

“This has been a long and drawn out class action. In all the circumstances we believe this is a just and equitable settlement. However, any class member can provide their input in court if they wish.” said Mr. Buckingham.

“We also have an extensive Frequently Asked Questions link on our webpages which should provide answers to most class members questions.” said Mr. Buckingham.

“We look forward to bringing this matter to closure and being in position to put payment in class members’ pockets early in the fall,” said Mr. Buckingham.
